There is a legal issue, but it has little to do with the physical 
aspects of the antennae unless of course it becomes contravenes local 
bylaws for height, stability, looks, or interferes with someone else's 
rights.  There are limitations to the amount of power that is allowed to 
be pumped through an unlicensed frequency.  There are still limitations 
even if you do have a license for a frequency.
